 Just Cause-the sensible and lawful ground for action. discharge-to perform one's duties and to dismiss someone from a job.

Wrongful dismissal- wrongful termination or wrongful discharge, describing a situation in which an employee's contract of employment has been terminated by the employer if the termination breaches one or more terms of the contract of employment, or a statute provision in employment law.

preponderance of the evidence-the greater weight of the evidence required in a civil lawsuit for the trier of fact to decide in favor of one side or the other.

Clear and convincing evidence-that the evidence presented by a party during the trial is more highly likely to be true than not and the jury or judge has a firm belief or conviction in it.

beyond a reasonable doubt- is the standard of evidence required to validate a criminal conviction in most adversarial legal systems.

 price list-a statement or list of the winning prices of the merchandise, stocks, specie, bills of exchange, or other matter dealt in issued statedly or sometimes by dealers to their customers and often giving other particulars.

Progressive discipline- the process of using increasingly acute steps or measures when an employee fails to correct a problem after being given a reasonable opportunity to do so.

 Oral warning-verbal warnings given to employees.

written warning-a verbal warning has failed to produce the desired result, therefore requiring stricter action, or if the offense for which a verbal warning was issued has been repeated.

suspension-Stage in disciplinary process where an employee is removed from his or her job for a certain time.

last chance agreement- is a written agreement between the union and the employer giving a worker who has been accused of engaging in some kind of serious misconduct, one last chance to keep his/her job.

 Due process- a legal requirement that the state must respect all legal rights that are owed to any person.

mitigating circumstances-Circumstances that may be contemplated by a court in determining guilt of a defendant or the extent of damages to be awarded to a plaintiff.
